Protocol to Amend the Vienna Convention on Civil Liability for Nuclear Damage

  1. The Protocol to Amend the Vienna Convention on Civil Liability for Nuclear Damage was adopted by a Diplomatic Conference, 8-12 September 1997, and was opened for signature at Vienna on 29 September 1997 at the 41st General Conference of the International Atomic Energy Agency. The Protocol will remain open for signature until its entry into force.

  2. Pursuant to Article 21, the Protocol will enter into force three months after the date of deposit of the fifth instrument of ratification, acceptance or approval. After its entry into force, any State which has not signed the Protocol may accede to it (Article 20.3).

  3. Attention is drawn to Article 19.1 which provides that a State which is a Party to the Protocol but not a Party to the 1963 Vienna Convention shall be bound by the provisions of that Convention as amended by the Protocol in relation to other States Parties to the Protocol, and failing an expression of a different intention by that State at the time of deposit of an instrument of ratification, acceptance, approval or accession shall be bound by the 1963 Vienna Convention in relation to States which are only Parties thereto.

  4. The text of the Protocol, taken from a certified copy, and the Annex thereto containing the consolidated text of the 1963 Vienna Convention as amended by the Protocol, prepared by the Secretariat pursuant to Article 24 of the Protocol, are reproduced herein for the information of all Members.
